Legislation Review Committee

 I have the great pleasure of acting as deputy chair of the Legislation Review Committee. It is one of four committees of which I am a member. I want to let the people of New South Wales know exactly what this committee does. The membership of the committee consists of the member for Auburn, who is the chair of the committee; me, as Deputy Chair; the member for Parramatta; the member for Leppington; the member for Upper Hunter; and Ms Sue Higginson, the Hon. Jacqui Munro and the Hon. Cameron Murphy from the Legislative Council. The committee is assisted by its secretariat. I thank the secretariat for its hard work. The committee scrutinises all bills introduced into the New South Wales Parliament.

The digest examines 16 pieces of legislation that have been put before Parliament, on which comments have been made, and six regulations where there have been no comments made. The Electoral Funding Amendment Bill seeks to expand the definition of administrative expenditure that can be claimed from the Administration Fund under the Electoral Funding Act 2018. The Act currently provides that if a member of Parliament can claim an expenditure item through their parliamentary allowance, they cannot claim this expenditure through the Administration Fund. The proposed amendments would create a specific exception for members' electoral allowances, which are a type of parliamentary allowance. These amendments would apply retrospectively from 1 April 2023.

The committee commented on provisions that are drafted to have retrospective effect. In this case, the committee noted that the retrospective application of the amendments would not adversely impact a person's rights or liberties. The committee also noted that the retrospective application is intended to provide legislative clarity for those making and determining claims for payment from the fund. For this reason, the committee made no further comment. That is the work that the Legislation Review Committee undertakes. I thank the chair, Lynda Voltz, who does an extraordinary job in making sure that those meetings are very efficient. Again, I thank all of my colleagues from this Chamber and from the other place. I acknowledge all the hard work by the secretariat. The committee does really important work. I commend the digest to the House and encourage everyone to have a good read of it during the break. It is well worth it.
